Having a Lasting Power of Attorney in place is something we believe to be essential when planning for the future. It allows you to decide who will handle your affairs and make important decisions should you become unable to do so for yourself.
Unfortunately, bad things can happen at any time, not just in old age. An accident or illness could render you incapable of managing your affairs and, without a Power of Attorney in place, your loved ones may have to go to the Court of Protection to obtain the authority to act on your behalf. This can be time-consuming and very expensive. By setting this up now, you are making things simpler for the future. By nominating someone to make decisions on your welfare and finance you ensure there is no uncertainty or hassle for your loved ones should there ever be a time it is needed. It is better to have and not need than to need and not have!
Many people do not realise that, although loved ones will be consulted over health and welfare matters, final decisions will be made by health professionals and may not necessarily be in accordance with the wishes of family members. An LPA gives the power to those closest to you to make the decisions you yourself would desire.
LPA’s are not restricted to matters of health or incapacity. Appointed Attorney’s can also act on your behalf in times of absence which could be useful for people spending time abroad, when it could be difficult to manage your own affairs in the UK.
LPA’s do not need to be registered immediately. Provided the documents are signed whilst the donor has full capacity, they can be held and only registered when required, for instance at a later date when mental capacity may have been lost.
There are two parts to Lasting Powers of Attorney, Property and Finance & Health and Welfare and the price for each is £350* inclusive of VAT.
